Sales Terms and Conditions.

At Royal Estates we will provide a professional service from the first viewing to completion.

Essential Information
At the commencement of our retainer we will require your full name, address and contact details. Your personal information will only be used by Royal Estates. In addition please advise us of any time deadline or other consideration.

Sale Particulars
We will provide photographs and written particulars to all puchasers. We are legally obliged to accuately represent your property.

Home Information Packs
These are mandatory as from 14 December 2007. The following documents must be included in your HIP:

  • Home Information Pack Index
  • Energy Performance Certificate (EPC)
  • sustainability information (required for newly built homes only)
  • sale statement
  • evidence of title

Standard searches (local authority and drainage and water)
Keys
We can act as your key holder and conduct all viewings on your behalf. No potential purchaser will view your property unaccompanied.

Commission
We charge 2% plus VAT of the final sale price and disbursementthis sum is payable on exchange either by you or your legal representative. You may pay by cheque or direct bacnk transfer to our solicitor.

Sole Agency
The period of our sole agency will last 12 weeks. After that period we will work with other agents to complete the sale. However our commission charged to you will remain unchanged.

Cancellation
You may cancel your contract with us at any time, notice in writing, after our sole agency has expired. However we reserve the right to charge an administration fee to cover our marketing expenses.

If within 6 months you sell to a purchaser we introduced to you, our commision will still be payable in full.

Deposit Monies
Any funds we hold on your behalf, will be held by our solicitor in a separate client account.

Sale of Property
In the event of a party introduced by the Agent (or any person or body corporate associated with that party) subsequently purchasing the Property, whether before or entering into a Tenancy Agreement, commission shall be payable by the Landlord to the Agent on completion of the sale at the rate of 1.5% of the sale price, plus VAT.

Value Added Tax
Fees are subject to VAT @ 15%

Insurance
The Landlord shall be responsible for the Property being adequately insured and confirms that the insurance policy covers the situation where the Property is let.

Legal Proceedings
Any delays of payment or other defaults will be acted on by the Agent in the first instance. Where the Agent has been unsuccessful in these initial actions, or there are significant rent arrears or breaches of the Tenancy Agreement, the Landlord will be advised accordingly. In the absence of any Rent Guarantee/Legal Protection Insurance, a solicitor would then be appointed and instructed by the Landlord (except where the Agent is unable to contact the Landlord, in which case the Agent is authorised to instruct a solicitor on the Landlord’s behalf). The Landlord is responsible for payment of all legal fees and any related costs.

Acceptance and Variation.
The terms and conditions of this Agreement may be varied by the Agent at any time or times, but only by prior written notification.

Sale of Property
